The Fair Work Commission (FWC) has made significant award decisions that impact businesses in the wine industry, including the removal of the absorption clause which is relevant to above award payments.
The FWC has extensively varied and renamed the Wine Industry Award as a result of the 4-yearly review of Modern Awards. The Wine Industry Award 2020 will commence operation and apply from November 13, 2020.
An earlier decision by the FWC to remove the absorption clause from 2020 Modern Awards is now relevant, given that the 2020 version of the Wine Industry Award is about to commence.
The FWC has decided to increase the National Minimum Wage by 1.75%. The FWC determined that this increase will flow on to Modern Awards in groups on three different operative dates.
The second group of Modern Awards will have their increases commence from the first full pay period on or after November 1, 2020. This includes the following awards that are applicable to some wine industry employers:
- Clerks – Private Sector Award 2020.
- Manufacturing and Associated Industries and Occupations Award 2020.
- Miscellaneous Award 2020.
