Using contractors

Commencing on February 1, 2019, labour hire providers (including vineyard contracting providers, picking and pruning gangs) must be licensed under the South Australian Labour Hire Licensing Act 2017 where they meet the definition of ‘labour hire services’. It is an offence to offer and use such services where the provider is required to be licensed and significant penalties apply.

The South Australian Wine Industry Association (SAWIA) will be presenting briefing sessions across SA’s wine regions designed for wine industry employers (wine producers, vineyard owners and winegrape growers) and providers of vineyard contracting services to assist in understanding the obligations and minimising the risk of penalties.

SAWIA will be conducting a session in the Riverland on Wednesday, September 26 at the Loxton Hotel.

The presentation will cover safety obligations as a client and provider of vineyard contracting services.  Key topics will include:

  • When is a business required to be licensed? Are there any exemptions?
  • How do you know if a provider is licensed?
  • What do you need to apply and what is the cost?
  • What happens if you use an unlicensed provider?
  • Inspection and auditing – who can enter your premises?
  • Safety requirements when using external contractors – what should be in place?
